Last week our senator, Al Franken refused to return his “blue slip” for 8th US Circuit Court of Appeals nominee David Stras, a Judge in the Minnesota Supreme Court. A blue slip is a tradition that allows U. S. senators to give their opinion about judicial nominees that come from their state. If a senator does not feel like the nominee is a good fit, they can refuse to return the blue slip. This tradition is supposed to encourage a more bipartisan consensus when it comes to appointing judges. While the blue slip is not legally binding, no circuit court judge has ever been confirmed after the objection of either one or both of the state senators. This move was used many times back when President Obama was appointing nominees.

Now that the shoe is on the other foot, Senate Majority Leader Mitch McConnell is not so sure about this blue slip tradition. He would like to see this practice discontinued for circuit court nominations, eliminating one of the few tools Democratic senators have to influence the selection of life long appointed judges.

Trump has the opportunity to appoint an unprecedentedly large amount of judges. Judges have lifetime appointments so the effects of this could be felt for decades tom come. So far, Trump’s nominees have been young, and incredibly right wing. We must continue to pay close attention to this and encourage our senators to continue to fight as best they can to appoint moderate, fair judges.
